How long must a company keep records?
Unofficial translation from the Vietnamese original.
Point d, clause 1, Article 14 of Law No. 13/2026/QH16 requires retention of records, documents and data relating to controlled activities; the specific retention period is to be set out by the Government in implementing regulations.
Pending those regulations, companies follow current sectoral requirements on customs, accounting and foreign trade management, and the record-keeping procedures in their internal compliance programme (point dd, clause 2, Article 5 of Decree No. 259/2025/ND-CP, detailed in Appendix II).
Practical recommendation: keep complete transaction records, correspondence with counterparties, name-screening results and end-user undertakings – these are the documents authorities most often ask for during verification.
